TERMS AND CONDITIONS.


Terms of Use

This agreement has been developed in all its parts to ensure the rights of customers and the rights of Pixel Mall (Fourth Dimension Technology Est. LLC) and to clarify the obligations of each party and this agreement is a contract effective from the date of the customer’s subscription with Pixel Mall and it is a contract between the two parties that must be adhered to by both parties.

Definitions:

Pixel Mall: It is the commercial name for web design services and printing designs approved, provided by Fourth Dimension Technology Est. LLC
Client: An individual who has obtained one of the services provided by Fourth Dimension Technology LLC.

General Provisions

To start using our services at Pixel Mall you agree that you are of the legal age to enter into a binding contract and service agreement between you and Pixel Mall (Fourth Dimension Technology Est. LLC). You agree to:

  • Provide true, current and complete information about yourself as required in the registration form to request a service (“Registration Data”)
  • Keep your registration data up to date to keep it correct, accurate, current and complete. If you provide any information that is untrue, inaccurate, incomplete and incomplete, or has reasonable grounds to suspect that such information is untrue, inaccurate, or inadequate, Pixel Mall has the right to suspend or terminate your account and refuse any and all current or future uses of the Service (or any portion thereof).
  • All services we provide are used for legitimate purposes only
  • We have the right to amend the terms of the agreement at any time with the notification of our existing customers.
  • When you register with Pixel Mall, all your personal and financial information is encrypted and kept strictly confidential, and is not accessible to anyone other than Pixel Mall employee except when requested by you yourself or at the request of judicial authorities.
  • We never sell your personal information, including your email address, but some of your information may only be used to send us offers, and you can request that you stop sending these offers at any time.
  • We use “cookies” in customer devices, in order to ensure the safety of communication and interaction between us and them. We only use “cookies” in the process of entering and exiting the customer from the control panel of his site and affiliated applications (see Privacy Policy).
  • We are committed to providing technical support at the level of maintenance and follow-up of the server only. Pixel Mall is not obligated to provide any kind of technical support services for any programs or systems installed on the server by the customer himself in exchange for operating a service in his location.
  • Pixel Mall has the right to cancel the contract with the customer and stop the service at any time with the reasons explained to the customer, and Pixel Mall is obligated to return all the customer’s remaining financial rights with a backup copy in the event that the reason for the cancellation is not one of the prohibited activities on our servers.
  • We care about our customers and always want the best for them, so Pixel Mall has the right to change any clause or article of this agreement at any time it sees fit, and that the customer is always supposed to be aware of these changes even if he does not receive any alert.

You will receive a password when you register an account with us. After completing the registration process for the Service, you are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password and account. You agree to:

  • You immediately notify Pixel Mall of any unauthorized use of your password or account or any other breach of security,
  • Ensure that you log out of your account at the end of each session by going to the logout link from your account control panel. Pixel Mall will not be liable for any loss or damage caused by your failure to comply with such order.
  • In case of renewal: The customer is obligated to renew on the due date for issuing his invoice, and the customer is notified of the renewal date at least 15 days in advance
  • We are not responsible for any business dealings outside our private ticketing system or email with any person and under any circumstances.
  • We reserve the right to refuse, terminate or cancel any contract, at our sole discretion.

All clients have the right to obtain stamped and certified hard copies from the company as official contracts in case the customer requests the service electronically and does not visit our offices. We will be happy to send a hard copy of the contract to the customer’s postal address. Please request the contract by opening a ticket in the customer service area.

Pixel Mall Privacy Policy

Data registration and some other information about you is subject to our Privacy Policy. For more information, see our Privacy Policy at the https://pixllmall.com/privacy-policy/  link, you understand that by using the Service you consent to the collection and use (as set forth in the Privacy Policy).

Payment Policy

  • The amount due will not be refunded if the customer violates any of the terms and rules agreed upon in the usage policy of the service provided
  • No refund is made after 5 days of delivery of the service
  • The amount due after receiving the work is not refunded without any clear justification or default in the terms of the joint offer
  • The refund is only made upon a direct request from the customer, and by a written message from the customer’s email registered with us, and after confirming with the customer personally via a phone call to the phone number registered with us
  • Bank financial deposits that are more than 30 days old and have not fulfilled their requests due to the failure of the owner to communicate with us through the phone, direct personal presence, or by e-mail or the ticket system approved by the Pixel Mall service, are considered null and void and the owner is not entitled to claim them or claim any service from Pixel Mall.
  • We do not bear any responsibility as a result of any mistake in the money transfer or bank deposits
  • When depositing money into our accounts, you must inform us to confirm the deposit within a period not exceeding 72 hours

Web Design Services

  • You must pay 50% of the amount before starting work on the service you requested from Pixel Mall.
  • The client must provide us with all the information required to carry out his work, and any other additional matters that we may need to know in order to better get out of the work, while stressing the need for the client to communicate with us throughout the work period, especially in the period of final reviews.
  • After studying the submitted application and concluding the agreement with the client, we adhere to the agreed period for the delivery of the work, and any delay that may occur by the client or failure to respond to our messages or confirmation of possible final copies of delivery, we do not bear any responsibility for it under any circumstances.
  • After completing the required work, it is presented to the customer, so that he can request any modifications (revisions), and the customer must clarify the modifications requested in full detail so that we can implement what he requests as quickly as possible.
  • We are not responsible for adding content to the site, of all kinds and forms, and in the event that the customer asks us to add content to his site, he must provide us with all the content required to be placed on the site, knowing that there will be additional fees for adding your content to the site.
  • After the completion of the work in full, the customer has the right to request any modification as agreed upon in the required design plan.
  • All amendments requested by the customer that were not agreed upon during the final agreement with the customer, the customer must pay an additional amount due to be agreed upon, and this clause relates to additional orders that are submitted after the final agreement
  • In all web design packages, our logo is placed at the bottom of each website we design with a link to the Pixel Mall website, and in the event that the customer does not want to put the logo and the link, he must pay an amount of 40% of the value of the work.
  • We are not responsible for any errors that the customer may make on his site, and the customer is not entitled to claim any modification or compensation for what may occur.
  • Technical Support is responsible for assisting the customer in all the work that we carry out only, and any work for other parties for which we do not provide any technical support.

Hosting Services

  • It is forbidden to use the Site or any of the Services for illegal purposes. Such as attacking or hacking a site, device, company or any network or attempting to do so, hacking, publishing and distributing copied or unauthorized materials or programs, deception, forgery, fraud, threatening, harassing any person, company or group, publishing pornographic or sexual material, spreading viruses or spyware, or placing links to sites containing such violations.
  • It is forbidden to violate intellectual property rights, distort the reputation of a person, institution or company, deliberately publish any information that causes harm to a company, person, country or group, and not to place hacking materials and stolen programs and all that violates Internet laws.
  • It is forbidden to use the site or any of the services to harm the provider (server) or other sites on the provider or any other sites, and Pixel Mall has the right to delete or block any program, page or files that cause harm to the server or the rest of the other sites.
  • Pixel Mall strictly prohibits the use of any of its devices or email provided for the purposes of sending advertising messages or spamming in violation of the laws. The customer’s use of mail for purposes contrary to the laws as mentioned above gives Pixel Mall the right to suspend or cancel the account without prior notice and the customer is not entitled to claim a refund of any amounts paid.
  • Pixel Mall has the right to stop any program or service added to any site in the event of any defect in it from a security or technical point of view, and in the event of suspension or disruption of this service, the subscriber is not compensated.
  • The customer is fully responsible for everything published on his site from a legal point of view, and Pixel Mall is not completely responsible for any damage that may be caused to your business or site while using any kind of program (scripts) or any defect in the sites that are destroyed by their owners or hacked or even as a result of a sudden stop from the server or as a result of malfunctions in its internal parts, and the subscriber is fully responsible for creating backup copies of site files, databases, mail contents and other content of its site.
  • We notify our customers before the end of the hosting period in several stages: a month ago, two weeks ago, three days ago, and one day before. These alerts come to you on your registered and approved email. Your default on the last day of your hosting will expose your website to immediate downtime. After 15 days of non-payment, we will permanently delete your site from our servers and the customer has no right to claim any backup copies. Pixel Mall does not bear any responsibility for damages that may be caused to the customer As a result of this suspension or cancellation of its services.
  • In the event of a breach of any of the terms of this Agreement, we will be forced to suspend your account with us without any prior notice or justification and without incurring any legal liability resulting therefrom.

Brand Design & Brand Identity Services

  • It is not possible to request a refund after the commencement of work in any case and whatever the circumstances that call for it, and when requesting a logo or printed design, half or full of the agreed amount must be paid before starting the design.
  • In the event of a delay in the delivery of the design to the customer and this delay is caused by a change in the customer’s requirements, a delay from the customer in the delivery of the required materials, or for any reason whatsoever on the customer’s side, Pixel Mall will not be responsible for this delay, and the remaining amount of the design value must be paid once the agreed period for completion of the design expires.
  • Upon completion of the design of any logo or publication, Pixel Mall will make all modifications that are not outside the scope of the agreement directly during the first week of the completion of the design, and then Pixel Mall is not responsible for any modifications requested nor for the duration of implementation of such modifications.
  • The official means of communication and communication approved in Pixel Mall is technical support tickets from the customer service area. As this system keeps all conversations and rehearsals in one place for easy review between the two parties.
  • Pixel Mall is not responsible at all for works that the customer delays in receiving or approving their rehearsals within a maximum period of 15 days from the date of sending the notification of the completion of the work or rehearsal.
  • When agreeing on the details of the contents of the logo or printed to be designed or developed, the customer is not entitled to claim after that the addition of any additions, no matter how minor or minor, under the framework of the current costs, but any addition or modification is calculated at a new cost independent
  • Pixel Mall is not responsible at all for the policies of other intermediary companies that are dealt with, such as electronic payment system companies, when using the electronic payment system and a financial problem occurs, you must review the intermediary company to find out the problem, so the institution is not committed to any compensation due to the problems that occur due to these companies.

You must read the agreement and agree to all terms before depositing or transferring amounts.  Once the service is agreed upon and the amount or part of it is transferred, the customer is considered to have agreed to these terms and all the terms and conditions of dealing mentioned on this page apply to him.
